Dear Brittany Lane Homeowners,
This letter is to formally address the recent annual meeting in which a recall vote was conducted. The recall was reviewed by the attorney for the HOA. According to Arizona State Statute §33-1819, the recall process carried out at that meeting did not meet the legal requirements necessary to remove any sitting board members.
As such, no board members were lawfully removed. The current Board of Directors for the Brittany Lane HOA remains in place, with the addition of Dennis, who was duly elected at the meeting.
The board members are:

• Kathy Edstrom
• Francis Murphy
• Amber Pommerening
• Dennis Smith
Arizona Revised Statute §33-1819 governs the procedures required for the removal of board members, and any action taken outside of those statutory requirements is not legally valid. The board, as listed above, will be holding an executive meeting in the coming days to discuss next steps.
